Overview

Currently, Hivos has two broad Strategic Themes which are; Green Society and
Open Society. It is under the Open Society that these ToRs are developed under
the _Protecting Rights, Openness, Transparency and Enhancing Civic
Transformation (PROTECT)_ Programme.
### Programme Summary
The PROTECT (Protecting Rights, Openness and Transparency Enhancing Civic
Transformation) Consortium brings together four leading organisations:
_ARTICLE 19, Hivos, Internews and the International Center for Not-for-Profit
Law (ICNL)_ , working on shifting the paradigm from unequal and closed
societies towards free and open societies with civil society including media
organisations, able to help people to hold governments to account. The
Consortium, alongside local and expert partners, will strengthen the
foundations for an open society in three target countries: Kenya, Malawi and
Myanmar*> by combining their worldwide expertise in the areas of _Civic Space,
Media Freedom, and Data Transparency._
Malawi – Challenges and Areas of Intervention
There are several challenges that PROTECT will tackle in Malawi. One of them
focuses on the growing public demand for and government commitment to
increasing transparency and accountability. However, corruption is endemic and
accessing government information remains a challenge for citizens, CSOs and
the media. Data literacy is limited in Malawi. Government, civil society,
media outlets and infomediaries are generally under-equipped to understand how
to work with the data they have access to.
PROTECT intervention to tackle contextualised threat of Transparency and
Accountability using Data
PROTECT seeks to translate complex data into actionable information for
marginalised groups, journalists and civil society. We will also address gaps
in the available data on gender inequality, building the capacity of
journalists and actors from vulnerable groups to access and use information to
improve government accountability.
### Scope of Work
PROTECT will use five actitity streams (approaches) to tackle country context
challenges. One the of the activity streams is Activity Stream 1 (AS1):
ENABLING THE POWER OF DATA. At national level many in civil society,
particularly women, face obstacles in utilizing the power and potential of
data analysis to effect change. To understand gaps in mobilising data, and the
gender-based information asymmetries, PROTECT will use a framework to reflect
the value chain of public data - flowing from generation, to use, to action
and response. The program will produce practical evidence on challenges facing
open societies to inform other activities; support locally driven multi-
stakeholder coalitions to bridge the supply-demand gap of data and support
infomediaries and media to contextualise and ‘translate’ complex data into
actionable information for broader segments of society and marginalized groups
to act upon.
AS1 Enabling The Power of Data Approach builds on existing frameworks through
five types of activity in the data value chain that contributes to the
democratisation of the knowledge in the society. Thus, using the innovative
4PD method- Problem driven; Process Driven, Proactive Disclosure, Pre-emptive
(Proactive) Demand . This innovative process approach to data management will
be used to generate evidence that will initiate and/or advance substantive
change in policies, practices and norms related to good governance and
sustainable development.
### Objective of Consultancy
To develop a strategy for developing the capacity of selected Government
Ministries, Departments and Agencies (MDAs) on the data supply side and
selected Civil Society Organisations (CSOs) on the demand side in the open
data generation, packaging, access and use.
Key Capacity*> Areas
The strategy will be expected to reflect acquisition of the following skills
and knowledge in the open data and government open data value chain:
1. _Problem Driven_ – based on the problem definition and the ideated possible solutions, actors identify what data is needed to create evidence to better understand it and to address the challenge.
2. _People-centred_ , that is the societal challenge should focus on a group of people for example, _access of young woman to public health services in Rumphi, Nkhotakota and Neno in Malawi._
3. _Multi-actor_ approach to indentify a possible solution to such a challenge using data.
4. _Data-driven_ , that is once actors have identified a societal challenge and establish a clear problem definition with stakeholders, they work together with government agencies to _identify and mobilize data_ so it can be used by stakeholders to create evidence, to inform action, decision making and policy.
5. _Process Driven_ – data availability does not lead to automatic accountability. Data needs to be used and stakeholders need to take action to ensure there is accountability results.
6. _Proactive Disclosure_ – the more government agencies move towards proactive publication of data, the more use-cases can spread.
7. _Proactive demand_ – actors or users are able think ahead of possible solutions for future challenges and pre-emptively demand data sets they will need.
### Methodology
The Development of the capacity building strategy should take into
consideration and refer to two key documents and any other relevant documents
the consultant may find useful in providing the framework for understanding
open data for accountability:
1. Coran L. (2017). _Mapping open data for accountability._ Transparency and Accountability Initiative and the Open Data Charter.
2. Carolan, L. (2016). _Open data, transparency and accountability: Topic guide_ . Birmingham, UK: GSDRC, University of Birmingham.
The selected consultant can obtain the above documents from the PROTECT
Consortium Country Coordinator in Malawi at Hivos Foundation Offices.
Due to restrictions to manage the COVID–19 pandemic, the selected consultant
shall be expected to make consultations with stakeholders and key informants
through online contacts and virtual meetings. For the same reason, use of
secondary sources providing empirical evidence of viable methods on data
capacity development strategies are encouraged. However, physical face to face
meetings in cases where they are acceptable or allowed should be considered as
the first option.
An online validation workshop will be conducted with key stakeholders to
review and agree on the final strategy. The consultant will advise on the
agenda of the workshop and will participate in the workshop to present the
outline of the strategy. The consultant will also revise and finalise the
strategy to incorporate the discussions and the agreements of the workshop.
### Key Deliverables
1. An inception report including a work plan, detailed methodology, report format and timeline, to be submitted within 7 days from the commencement of the assignment.
2. A draft capacity development strategy addressing at least the following key issues:
1. Capacity needs and gaps in open data at organisational and individual levels among selected MDAs and CSOs.
2. Current capacity development opportunities including existing skills and knowledge in open data.
3. Specific capacity needs and priorities at organisational level among selected MDAs and CSOs and at individual levels
4. Recommendations for the most suitable, effective, efficient and affordable modes of capacity development to meet the identified needs.
3. Agenda of the validation workshop.
4. Presentations and participation at the validation workshop as agreed with the Consortium PROTECT Country Coordinator.
5. Final capacity development strategy taking into account the results of the validation workshop.
### Supervision and Collaboration
The Consultant will work under the supervision of PROTECT Regional Programme
for Hub Southern Africa in collaboration with the PROTECT Consortium Country
Coordinator to finalise the methodology, to collect the data and to facilitate
interviews and contacts with key stakeholders.
This is mainly a desk-based assignment. No travels are envisaged. The
consultant will be expected to make imaginative use of online networking (and
questionnaires, surveys, etc. if necessary) to obtain the required information
and conduct consultations. It is expected that the information.
Time schedule
The Assignment shall be expected to be completed within a maximum of 30 work
days with the following tentative schedule:
1. By 22 nd June: Draft of inception report completed;
2. By 17 th July: Draft strategy for capacity development completed;
3. By 24 th July: Draft Agenda of workshop completed;
4. By 31 st July: Presentations for the workshop completed;
5. By 15 th August: Final delivery of capacity development strategy taking into account the results of the validation workshop.
### Your Profile
The consultant is expected to have the following skills and expertise:
1. Advanced degrees in Social Sciences, Economics, Development Studies, or related discipline;
2. A minimum of five (5) years’ experience in conducting individual and organisational capacity needs assessments.
3. At least five (5) years of experience working in organizational development and capacity building in protected areas;
4. Excellent writing and communication skills in English;
5. Strong interpersonal skills and the ability to communicate and work well with diverse people
6. Ability to effectively organise virtual meetings and carry out consultations online

Evaluation of applications (Criteria for Selection of Best Offer)
A combined Scoring method will be used in the selection of the consultant. The
Technical Proposal (qualifications, experience and approach/methodology and
providing initial observations on the ToRs) will be weighted a maximum of 70%
while the Financial Proposal (price offer) for completion of the required
tasks, including the daily rate used for calculations will be weighted a
maximum of 30%.
